Cancellation Policies

Student Cancellation Policy

Purpose:  In an effort to effectively provide all interested excavators with the opportunity to attend scheduled CEP classes, Dig Safely New York has issued the following Student Cancellation Policy for all registered CEP class Registrants, in addition to the Class Cancelation Policy.

  • Upon registering for the CEP class through digsafelynewyork.com, Registrants will be subject to this Student Cancellation Policy.
  • All cancellation requests must be made to the class administrator by e-mail.
  • Registrants who cancel their registration up to 7 days before the date of the class will receive a refund of 80% of their class fee (however, a $5.00 administration fee will be assessed from the refund).  This refund will be provided in the same manner as payment was received. For check reimbursements allow 4 weeks.
  • Cancellations 1-7 days prior to the class date are subject to payment for the full amount
  • Rescheduling for a future scheduled CEP class up to 7 days before the date of the original class can be done with no penalty.
  • Rescheduling for a future scheduled CEP class 1-7 days prior to the class date will be subject to a $10.00 administration fee.
  • Registrant substitutions may be made at any time.
  • Please note that if the Registrant does not cancel or does not attend the CEP class(es), the Registrant is responsible for payment, and no refund will be provided.
  • In the event that attorneys’ fees, costs or any other expenses are incurred by Dig Safely New York due to Registrant’s failure to pay for the CEP classes, or breach of this Student Cancellation Policy, Registrant agrees to pay said attorneys’ fees, costs and expenses in connection therewith.

 

Class Cancellation Policy

Purpose:  In an effort to establish a viable and cost effective class environment for the Certified Excavator Program (CEP), Dig Safely New York has issued the following Class Cancellation Policy for all Registrants, in addition to the Student Cancellation Policy.

  • Upon registering for the CEP class through digsafelynewyork.com, Registrants will be subject to this Class Cancellation Policy.
  • Dig Safely New York reserves the right to cancel or change a class for any reason, including but not limited to: lack of participation, classroom, and equipment or trainer availability.
  • Dig Safely New York reserves the right to cancel or change a class at any time, including the day of the class.  Dig Safely New York will try to provide notification of class cancellation at least 4 days before the class, whenever possible.
  • In the event Dig Safely New York cancels a class, through no fault of the Registrant, the Registrant will not be charged for the class and will be reimbursed in full in the same manner as payment was received.  For check reimbursements please allow 4 weeks.
  • Dig Safely New York is not liable for any direct, indirect, consequential or special damages that may be incurred due to a cancellation or change of a scheduled class, including, but not limited to: cancellation penalties for transportation or accommodations. The customer or student's sole remedy shall be the refund of prepaid course fees.
  • In the event that attorneys’ fees, costs or any other expenses are incurred by Dig Safely New York due to Registrant’s failure to pay for the CEP classes, or breach of this Class Cancellation Policy, Registrant agrees to pay said attorneys’ fees, costs and expenses in connection therewith.
